These Terms of Service ("Terms") govern your access to and use of the Talksies website and service (the "Service") operated by Martin Gottweis("we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
What Talksies is
Talksies is an AI-assisted chat for two people who disagree. An AI mediator hears each side privately, then keeps the shared conversation fair and on topic, and may hold a message and suggest a calmer version before it is posted. It is not a substitute for legal advice, therapy, counseling, or professional mediation. See our AI & Mediation Disclaimer for important limitations.
Eligibility
You must be at least 16 years old (or the age of digital consent in your country) to use the Service. By using it, you confirm that you meet this requirement.
Prototype / beta
The Service is an early-stage product provided on an "as is" and "as available" basis. It may change, break, lose data, or be discontinued at any time without notice. Rooms are deleted after 30 days of inactivity. Do not rely on it for anything critical.
Acceptable use
You agree not to use the Service to:
- Harass, threaten, abuse, defame, or endanger any person.
- Share another person's private information without their consent.
- Break the law or facilitate illegal activity.
- Impersonate someone or misrepresent your identity in a harmful way.
- Upload malware, attempt to breach security, or disrupt the Service.
- Scrape, resell, or build a competing dataset from the Service.
- Share a room link with anyone other than the person you intend to talk with.
The mediator may refuse to post messages that contain threats or personal information about others. Those are the only cases where you cannot post a message over its objection.
Your content
You are responsible for the content you submit. You confirm you have the right to share it and that it does not violate anyone's rights. You grant us a limited license to process your content solely to operate the Service (including sending it to our AI provider to generate responses), as described in the Privacy Policy.
No guaranteed outcome
The Service does not guarantee that a disagreement will be resolved, that the other person will join or stay, or that any agreement reached is fair, binding, or enforceable. Any agreement between you and another person is between you, not with us.
Intellectual property
The Service, including its design, code, and branding, belongs to us and is protected by applicable laws. These Terms do not grant you any rights to our trademarks or software except the right to use the Service as intended.
Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. AI-generated content may be inaccurate, incomplete, or inappropriate.
Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law.
Indemnity
You agree to indemnify and hold us harmless from claims and expenses arising out of your misuse of the Service or violation of these Terms.
Termination
We may suspend or terminate access to the Service at any time, including for violation of these Terms. You may stop using the Service at any time and request deletion of your data through the contact page.
Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. Any disputes will be handled by the courts located there, unless mandatory local law provides otherwise.
Changes to these Terms
We may update these Terms from time to time. Material changes are reflected by updating the "Last updated" date above. Continued use of the Service means you accept the updated Terms.
